The focus is no longer just on \u201cregistering\u201d: now it matters <strong data-start=\"498\" data-end=\"510\">blow<\/strong> intangible assets with speed, documentary evidence, and auditable contracts. In parallel, the legislator established <strong data-start=\"620\" data-end=\"638\">maximum deadlines<\/strong> for IMPI resolutions and created a mechanism for <strong data-start=\"691\" data-end=\"714\">for IMPI resolutions and created a mechanism for<\/strong> when the authority fails to meet deadlines.<\/p>\n<p data-start=\"755\" data-end=\"1030\">If your operation is in Mexico City (R&amp;D, manufacturing, software, pharma, food, franchises, consumer goods), this reform impacts your <strong data-start=\"879\" data-end=\"897\">time-to-market<\/strong>, you <strong data-start=\"902\" data-end=\"922\">IP rating<\/strong>, and your <strong data-start=\"930\" data-end=\"962\">risks of nullity\/expiration<\/strong> due to a poorly executed strategy.<\/p>\n<hr data-start=\"1032\" data-end=\"1035\" \/>\n<h2 data-section-id=\"pz9fx1\" data-start=\"1037\" data-end=\"1095\">1) What is the LFPPI Reform 2026 and when did it come into effect<\/h2>\n<p data-start=\"1096\" data-end=\"1561\">The <strong data-start=\"1099\" data-end=\"1110\">Decreto<\/strong> which amends the Federal Law for the Protection of Industrial Property (LFPPI) was published on <strong data-start=\"1200\" data-end=\"1222\">April 3, 2026<\/strong> and <strong data-start=\"1225\" data-end=\"1260\">It came into effect the following day.<\/strong> (April 4, 2026), with a transitional rule: pending matters are concluded under the rule in force at the beginning, <strong data-start=\"1378\" data-end=\"1387\">except<\/strong> that the new \u201cmandatory resolution\u201d mechanism can be activated in pending cases <strong data-start=\"1469\" data-end=\"1490\">once integrated<\/strong> the Specialized Technical Committee.<\/p>\n<p data-start=\"1563\" data-end=\"1605\">Strategically, this creates two universes:<\/p>\n<ul data-start=\"1606\" data-end=\"1784\">\n<li data-section-id=\"1vhsw06\" data-start=\"1606\" data-end=\"1690\"><strong data-start=\"1608\" data-end=\"1632\">Legacy files<\/strong>: they are governed by prior rules (in the substantive aspects of the procedure).<\/li>\n<li data-section-id=\"va9ych\" data-start=\"1691\" data-end=\"1784\"><strong data-start=\"1693\" data-end=\"1723\">\u201cPost-reform\u201d files<\/strong>They are born with new time goals and procedural tools.<\/li>\n<\/ul>\n<p data-start=\"1786\" data-end=\"1997\">For legal and compliance departments, the correct question is no longer \"has it been filed?\", but: <strong data-start=\"1881\" data-end=\"1959\">Under what procedural regime is your portfolio and what levers can you already activate?<\/strong><\/p>\n<hr data-start=\"1999\" data-end=\"2002\" \/>\n<h2 data-section-id=\"x11vb1\" data-start=\"2004\" data-end=\"2102\">2) Technology transfer: the silent change that affects contracts (more than forms)<\/h2>\n<p data-start=\"2103\" data-end=\"2517\">The reform did not \u201conly\u201d speed up procedures: <strong data-start=\"2142\" data-end=\"2167\">redefined priorities<\/strong> of the system. In particular, it strengthened the role of IMPI to <strong data-start=\"2225\" data-end=\"2248\">promote and encourage<\/strong> inventions applicable industrially and commercially, as well as <strong data-start=\"2310\" data-end=\"2341\">transfer of technology<\/strong> and its marketing, including legal advice on <strong data-start=\"2400\" data-end=\"2439\">licenses, assignments and transfers<\/strong> linked to transfer agreements.<\/p>\n<h3 data-section-id=\"ho7t3t\" data-start=\"2519\" data-end=\"2586\">Why this matters to businesses (CDMX and national operations)<\/h3>\n<p data-start=\"2587\" data-end=\"2677\">In corporate transactions, technology transfer typically fails due to three weaknesses:<\/p>\n<ol data-start=\"2678\" data-end=\"2971\">\n<li data-section-id=\"1b68g4g\" data-start=\"2678\" data-end=\"2780\"><strong data-start=\"2681\" data-end=\"2727\">Actual ownership vs. \u201cassumed\u201d ownership<\/strong> (inventors, employees, consultants, co-development).<\/li>\n<li data-section-id=\"kdp4kl\" data-start=\"2781\" data-end=\"2870\"><strong data-start=\"2784\" data-end=\"2819\">Know-how without chain of custody<\/strong> (manuals, datasets, parameters, recipes, code).<\/li>\n<li data-section-id=\"h0mx7r\" data-start=\"2871\" data-end=\"2971\"><strong data-start=\"2874\" data-end=\"2902\">Poorly calibrated licenses<\/strong> (territory, field of use, sublicense, improvements, audit, exit).<\/li>\n<\/ol>\n<p data-start=\"2973\" data-end=\"3337\">With the reform, the IMPI is mandated to operate in an environment where <strong data-start=\"3042\" data-end=\"3060\">the exploitation<\/strong> and the <strong data-start=\"3066\" data-end=\"3086\">marketing<\/strong> They are part of the objective. This raises the expected standard of documentary order: in audits (M&amp;A), financing, or enforcement, the \"pretty contract\" without operational evidence and internal controls becomes fragile.<\/p>\n<h3 data-section-id=\"u5sn9j\" data-start=\"3339\" data-end=\"3419\">2.1 Licensing and transfer: typical risks that are now becoming litigable<\/h3>\n<p data-start=\"3420\" data-end=\"3675\"><strong data-start=\"3420\" data-end=\"3482\">Risk A \u2014 License without improvement control:<\/strong><br data-start=\"3482\" data-end=\"3485\" \/>If your licensee develops improvements and your contract does not define whether they belong to the licensor, the licensee, or are shared, you could lose competitive advantage or trigger exploitation disputes.<\/p>\n<p data-start=\"3677\" data-end=\"3909\"><strong data-start=\"3677\" data-end=\"3726\">Risk B \u2014 Sublicensing \u201cby custom\u201d:<\/strong><br data-start=\"3726\" data-end=\"3729\" \/>In distribution chains (retail, OEM\/ODM, integrators), informal sublicensing is common. Controversially, this unproven \u201cpermitted use\u201d becomes <strong data-start=\"3887\" data-end=\"3908\">unauthorized use<\/strong>.<\/p>\n<p data-start=\"3911\" data-end=\"4181\"><strong data-start=\"3911\" data-end=\"3959\">Risk C \u2014 Territory vs. digital channels:<\/strong><br data-start=\"3959\" data-end=\"3962\" \/>Many contracts still focus on physical territory. In SaaS and e-commerce, the real \"territory\" is access. If you don't define geoblocking, allowed users, and jurisdiction, a lawsuit will come before renegotiation.<\/p>\n<p data-start=\"4183\" data-end=\"4421\"><strong data-start=\"4183\" data-end=\"4258\">Risk D \u2014 Confusion between trade secrets and controlled disclosure:<\/strong><br data-start=\"4258\" data-end=\"4261\" \/>If you share know-how without controls (robust NDA, need-to-know, logs, labels, access), your \"secret\" degrades and enforcement becomes an uphill battle.<\/p>\n<p data-start=\"4423\" data-end=\"4680\">The reform does not create these risks; but it does give the \"transfer\" greater political and operational centrality. Result: <strong data-start=\"4551\" data-end=\"4609\">more contractual friction and more incentives to litigate<\/strong> when there is real economic value.<\/p>\n<hr data-start=\"4682\" data-end=\"4685\" \/>\n<h2 data-section-id=\"22crzl\" data-start=\"4687\" data-end=\"4774\">3) \u201cFast Track\u201d in IMPI deadlines: new goals that rewrite your business calendar<\/h2>\n<p data-start=\"4775\" data-end=\"4834\">The reform introduced <strong data-start=\"4796\" data-end=\"4814\">maximum deadlines<\/strong> at critical points.<\/p>\n<h3 data-section-id=\"1jp5tfy\" data-start=\"4836\" data-end=\"4937\">3.1 Patents, utility models and industrial designs: 1 year limit (from substantive examination)<\/h3>\n<p data-start=\"4938\" data-end=\"5161\">Added the <strong data-start=\"4951\" data-end=\"4971\">Article 111 Bis<\/strong>, establishing that the IMPI must definitively resolve the granting or refusal <strong data-start=\"5054\" data-end=\"5073\">within a maximum of 1 year<\/strong>, counted from when the <strong data-start=\"5103\" data-end=\"5122\">background exam<\/strong>.<\/p>\n<p data-start=\"5163\" data-end=\"5240\">Business involvement: Your R&amp;D and launch strategy must synchronize:<\/p>\n<ul data-start=\"5241\" data-end=\"5407\">\n<li data-section-id=\"t5shu4\" data-start=\"5241\" data-end=\"5304\"><strong data-start=\"5243\" data-end=\"5267\">publication date<\/strong> (and eventual early publication),<\/li>\n<li data-section-id=\"1icudjj\" data-start=\"5305\" data-end=\"5339\">actual start of the in-depth examination,<\/li>\n<li data-section-id=\"1qpvpen\" data-start=\"5340\" data-end=\"5407\">response to official actions (now with an efficiency focus).<\/li>\n<\/ul>\n<h3 data-section-id=\"11eutg9\" data-start=\"5409\" data-end=\"5446\">3.2 Integrated circuits: 2 months<\/h3>\n<p data-start=\"5447\" data-end=\"5632\">For integrated circuit layout schemes, the maximum resolution is <strong data-start=\"5521\" data-end=\"5532\">2 months<\/strong> from the presentation (or from when you meet the requirements).<\/p>\n<h3 data-section-id=\"1xn2g1r\" data-start=\"5634\" data-end=\"5709\">3.3 Trademarks, notices and trade names: 5 months (with and without opposition)<\/h3>\n<p data-start=\"5710\" data-end=\"5752\">In the distinctive signs procedure:<\/p>\n<ul data-start=\"5753\" data-end=\"6037\">\n<li data-section-id=\"10gy9ic\" data-start=\"5753\" data-end=\"5882\">Following the arguments, the IMPI must issue a ruling <strong data-start=\"5801\" data-end=\"5841\">within a period not exceeding 5 months<\/strong>.<\/li>\n<li data-section-id=\"1hodcm3\" data-start=\"5883\" data-end=\"6037\">If <strong data-start=\"5888\" data-end=\"5913\">there are no requirements<\/strong> no <strong data-start=\"5917\" data-end=\"5930\">opposition<\/strong>, the maximum time limit for resolution is <strong data-start=\"5965\" data-end=\"5998\">5 months since submission<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"6039\" data-end=\"6328\"><strong data-start=\"6039\" data-end=\"6060\">Practical reading:<\/strong> If your brand is essential (retail, franchise, consumer goods), the bottleneck should no longer be \"the IMPI takes too long,\" but <strong data-start=\"6177\" data-end=\"6213\">your ability to present solid<\/strong> (preliminary research, class strategy, distinctiveness tests, usage control) and to respond without improvisation.<\/p>\n<hr data-start=\"6330\" data-end=\"6333\" \/>\n<h2 data-section-id=\"ehd0vf\" data-start=\"6335\" data-end=\"6417\">4) The real \u201cfast track\u201d: Mandatory resolution when the IMPI does not meet deadlines<\/h2>\n<p data-start=\"6418\" data-end=\"6463\">The reform created a <strong data-start=\"6437\" data-end=\"6458\">Title Five Bis<\/strong> with:<\/p>\n<ul data-start=\"6464\" data-end=\"6634\">\n<li data-section-id=\"18c1ynx\" data-start=\"6464\" data-end=\"6518\"><strong data-start=\"6466\" data-end=\"6498\">Specialized Technical Committee<\/strong> (art. 327 Ter), and<\/li>\n<li data-section-id=\"122gwgt\" data-start=\"6519\" data-end=\"6634\"><strong data-start=\"6521\" data-end=\"6575\">Procedure for Issuing a Mandatory Resolution<\/strong> (art. 327 Quater).<\/li>\n<\/ul>\n<p data-start=\"6636\" data-end=\"6883\">Furthermore, the law provides that this mandatory resolution can be requested when procedures are not resolved within the established deadlines (including, among others, the articles on deadlines in patents and trademarks).<\/p>\n<h3 data-section-id=\"kuapnm\" data-start=\"6885\" data-end=\"6913\">What changes for businesses?<\/h3>\n<p data-start=\"6914\" data-end=\"7284\">Previously: your file could \"sleep\" and your only real alternative was informal administrative pressure or indirect strategies (divisional, re-presentation, etc.).<br data-start=\"7077\" data-end=\"7080\" \/>Now: there is a legal avenue to <strong data-start=\"7114\" data-end=\"7135\">force definition<\/strong> (granting or refusal), with a committee that must <strong data-start=\"7186\" data-end=\"7222\">to know and determine origin<\/strong> of these requests.<\/p>\n<h3 data-section-id=\"1xw9dvj\" data-start=\"7286\" data-end=\"7339\">Strategic gray area (where you win or lose)<\/h3>\n<p data-start=\"7340\" data-end=\"7402\">This mechanism is not an \u201cautomatic pass\u201d. In practice, it can:<\/p>\n<ul data-start=\"7403\" data-end=\"7568\">\n<li data-section-id=\"s6j27i\" data-start=\"7403\" data-end=\"7491\"><strong data-start=\"7405\" data-end=\"7417\">accelerate<\/strong> certainty (valuable in investment rounds or licensing agreements), but also<\/li>\n<li data-section-id=\"rufg0\" data-start=\"7492\" data-end=\"7568\"><strong data-start=\"7494\" data-end=\"7521\">precipitate a refusal<\/strong> if your file is not ready for closure.<\/li>\n<\/ul>\n<p data-start=\"7570\" data-end=\"7749\">In serious corporate portfolios, the rule should be: <strong data-start=\"7625\" data-end=\"7684\">Only press when the quality of the file withstands it<\/strong> (claims, support, priority, formalities, evidence).<\/p>\n<hr data-start=\"7751\" data-end=\"7754\" \/>\n<h2 data-section-id=\"tu07ad\" data-start=\"7756\" data-end=\"7848\">5) Patents and transfer: provisional application and tools to avoid losing rights<\/h2>\n<p data-start=\"7849\" data-end=\"8280\">The reform incorporated the <strong data-start=\"7873\" data-end=\"7919\">provisional patent application in Mexico<\/strong>It is sufficient to identify the inventor\/successor in title and provide a description that allows the invention to be identified. Then there is a non-extendable deadline of <strong data-start=\"8062\" data-end=\"8074\">12 months<\/strong> to submit the full application. This provisional application is not published or examined, and does not \"carry over\" priority to other applications as a PCT would.<\/p>\n<p data-start=\"8282\" data-end=\"8505\">Figures were also added of <strong data-start=\"8314\" data-end=\"8346\">restoration of rights<\/strong> in the event of abandonments due to non-compliance with requirements, with a deadline of <strong data-start=\"8421\" data-end=\"8440\">15 business days<\/strong> in the foreseen case.<\/p>\n<h3 data-section-id=\"bhqxwx\" data-start=\"8507\" data-end=\"8552\">How does technology transfer have an impact?<\/h3>\n<p data-start=\"8553\" data-end=\"8622\">In licensing and capital raising, the provisional license is useful for:<\/p>\n<ul data-start=\"8623\" data-end=\"8787\">\n<li data-section-id=\"5ga50y\" data-start=\"8623\" data-end=\"8678\"><strong data-start=\"8625\" data-end=\"8643\">secure date<\/strong> while you mature your demands,<\/li>\n<li data-section-id=\"zueg4n\" data-start=\"8679\" data-end=\"8724\">to negotiate with a structured \"patent pending\",<\/li>\n<li data-section-id=\"oecb2d\" data-start=\"8725\" data-end=\"8787\">organize the innovation pipeline (by business units).<\/li>\n<\/ul>\n<p data-start=\"8789\" data-end=\"8982\">But there is a business risk: if you use provisional measures as a \"patch\" without an internal process (logs, disclosure forms, invention committee), they become <strong data-start=\"8947\" data-end=\"8971\">silent expiration<\/strong> month 12.<\/p>\n<hr \/>\n<p data-start=\"8984\" data-end=\"9224\"><br data-start=\"9025\" data-end=\"9028\" \/><strong data-start=\"9028\" data-end=\"9224\">Don't face this process alone. sublicense, confidentiality).<\/li>\n<li data-section-id=\"1kbxqg8\" data-start=\"11307\" data-end=\"11524\"><strong data-start=\"11310\" data-end=\"11338\">Portfolio strategy<\/strong>With tighter deadlines, errors due to haste increase: poor evidence, mismanaged priorities, or incomplete responses.
